DRAFT MINUTES OF THE ANNUAL GENERAL PARISH COUNCIL MEETING HELD ON
MONDAY 13th MAY 2019 IN THWAITES VILLAGE HALL, COMMENCING AT 07.00PM
PRESENT: Cllr B Wright, Cllr J Gray, Cllr I Lockwood, Cllr A Nugent , Cllr M Kitchingman, , Cllr A Calsy and Cllr G Napoletani
3 members of public were present
1/19 ELECTION OF OFFICERS. Cllrs Savage and Wright stood down. In the absence of the Chair, Cllr Wright took the Chair to conduct the election.
Nomination for Chairman – Cllr D Savage (In his absence Cllr Savage had expressed a desire to be re-elected as Chair). Proposed by Cllr Lockwood, Seconded by Cllr Calsy. There being no other candidates, Cllr Savage was duly elected.
Nomination for Vice Chair – Cllr I Lockwood. Proposed by Cllr Napoletani, Seconded by Cllr Nugent. There being no other candidates, Cllr Lockwood was duly elected.
2/19 After signing the acceptance of office, Cllr Lockwood took over the chair in the absence of Cllr Savage.

4/19 Minutes of Annual General Meeting 21st May 2018
The Minutes of the Annual General Meeting held on 21st May 2018 were approved and signed by the Chair. Proposed by Cllr Gray, seconded by Cllr Nugent.
5/19 It was resolved that the Parish Council meets the conditions under section 8(2) of the Localism Act 2011 and The Parish Councils (General Power of Competence) (Prescribed Conditions) Order 2012 and therefore may act under the General Power of Competence.
6/19 APPOINTMENT OF MEMBERS TO SERVE ON OUTSIDE BODIES

10/19 Police Liaison Report
No report had been received. The Clerk reported that she was investigating.
11/19 PROGRESS REPORTS
11/19.1 Fell View
It was reported that the Notice had been granted. Cllr Wright reported that he had attended the CBC Planning meeting along with Cllr Savage. Although representations had been made and the planning decision challenged, the views of the Parish Council had not been heeded. Cllr Wright was disappointed in the way the panel was conducted, the lack of discussion within the panel on the matter and that due processes had not been correctly followed. The Parish Council to consider whether to ask the Secretary of State for a Judicial Review of the decision, but this would have financial implications for the Parish and residents would have to be consulted before any decision could be taken.
Cllr Wright stated that this was not against the individual who had submitted the planning application but of the performance of CBC Planning Department and Planning Panel and their failures to follow procedures and include all evidence in submissions.
12/19 PUBLIC PARTICIPATION
Retiring councillor Huck congratulated the councillors on being re-elected and wished them well. He cited a quote from Tolkien..
13/19 COUNTY COUNCIL AND DISTRICT COUNCILLORS’ REPORTS
The Clerk reported that she was trying to get contact details for the newly elected Borough Councillors McGraw and Wilson to invite them to the next meeting.
14/19 APPLICATIONS FOR DEVELOPMENT:
14/19.1 To examine applications for development and submit observations to the Planning Authority
4/19/2135 Erect Roof over existing midden and concrete floor to existing Big Bale Silage store

The Council resolved to support this application.
7/2019/4034 New Free Standing, floor mounted solar panel array

The Clerk was instructed to seek an extension to respond to this application
14/19.2 To ratify the observations submitted by the Clerk under devolved powers since the last meeting.

14/19.3 To note the decisions of the statutory planning authority with regards to recent applications
7/2019/4018 Temporary stoned access to Furnace Wood off the Corney Fell Road to facilitate the removal of diseased larch trees and conifers from a designated Planted Ancient Woodland site.

15/19 FINANCIAL RECORDS
15/19.1 The following payments were approved:
CALC Annual subscription £178.58
V Bradley Internal Audit fee £ 65.00
Zurich Municipal Insurance renewal £369.70
15/19.2 To note the receipt of payments
Parish Precept £8400.00
15/19.3 To receive and note the bank reconciliation statements dated 30 April 2019
The bank reconciliation had been completed by the Clerk and presented to the Council for approval. This was checked and verified by Cllr Kitchingman
15/19.4 To consider the Budget Comparison Report as at 30 April 2019 and determine action need to address deviations from the budget.

15/19.5 Schedule of Assets
It was RESOLVED that the Schedule of Assets presented to the meeting were correct. Proposed by Cllr Calsy, Seconded by Cllr Wright
15/19.6 To receive and note the accounts for the year ending 31 March 2019 have been submitted and approved by the internal auditor and that they are a true and correct record.
Proposed by Cllr Gray and seconded by Cllr Kitchingman to accept the audited accounts
15/19.7 To determine that the Parish Council has met the qualifying criteria to certify them as exempt from a limited assurance review.
The Council were satisfied that the Parish Council met all qualifying criteria to submit a certificate of exemption. Proposed by Cllr Wright, Seconded by Cllr Calsy
16/19 PARISH MATTERS
16/19.1 Community Plan
Cllr Nugent gave an update on the progress of items under the Plan. Work is being carried out by the community on researching play areas. The Steering Group were tweaking the final Community Plan which would be launched at the Annual Parish meeting on Wednesday 28 May at Thwaites Village Hall. It was suggested that wine and cheese be served. Copies of the action plan and some copies of the Community Plan would be available at the meeting.
It was proposed by Cllr Napoletani and Seconded by Cllr Calsy that the Community Plan be accepted.
16/19.2 Traffic Management
Cllr Lockwood reported that he and Cllr Savage had met with CCC Highways and discussed a number of topics. The signs “not fit for vehicles” are going up on Aggie’s Lonnin. Concerns were raised about the School Ellis/Dunningwell Road and the speeding on A5093. The County Reduction Safety Highways Committee are to undertake another speed exercise on A5093 to show that a need is required for further speed reduction measures. The speed limit will not be altered. Money has been obtained from Ghyll Scaur Quarry Highways fund for a community speeding device, once the exercise has been completed.
16/19.3 Parish Projects
Tree Maintenance
The Clerk reported she was awaiting an update from the contractor for the Pinnel Hole. Cllr Lockwood asked if there had been a response to the letter to the resident re fly tipping at Hill Brow. As there had been no response the Clerk was asked to write again stating that further action would be taken if the items were not removed.
Bus Shelters
Cllr Gray reported that there had been no progress, but he was still pursuing the matter.
Litter bins
The Clerk reported that there had been no response to the request and would chase up
Derelict Houses
Cllr Calsy reported that she was still pursuing the issue.
PROWs Challenge
It was agreed that this would be dealt with within the Community Plan – Connectivity
Land Lease Agreement – Pinnel Hole
A request had been received from the owner of Styall Side to take over the Land lease agreement for a garage at the Pinnel Hole. It was agreed that the application would be accepted. Cllr Kitchingman suggested that the process and review of licences should take place.
Annual Parish Meeting 28 May 2019
To be held at Thwaites Village Hall. It was suggested that cheese and wine should be offered.
Southern Boundary Partnership
Cllr Lockwood reported that community conversations would now be held towards the end of June/beginning of July 2019. Waiting for FOLD to give details/final report. Another meeting to be arranged when the report is published.
17/19 Reports from outside Bodies
Cllr Lockwood reported that he had attended the South Copeland Partnership meeting. A number of community plans were coming together.
SLDC were reviewing the proposal for another footbridge at Duddon Bridge to link the coastal path. It was still uncertain what would happen at the Network Centre in Millom. The library has been handed over to Millom Town Council from CCC.
18/19 CORRESPONDENCE
The following correspondence had been received:
A request from Citizen’s Advice Bureau for a donation. This would be reviewed later in the year.
19/19 COUNCILLOR MATTERS
Cllr Calsy raised concerns re suspected developments in Gornal Ground Wood. Dogs were seen running loose and there had been reports of sheep worrying. Cars are there late at night. A party had been held in the woods and trail bikes were seen racing around. Neighbours were concerned about noise nuisance and had requested that the Planning Enforcement Officer attend, but as yet had no response. The clerk advised that should there be future events and noise that residents contact the police and complain. The Clerk to contact PCSO Booth.
Cllr Lockwood asked if there had been any response from the planning department re Hazel Lodge
